By accessing or using SD Automate, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Eligibility

You must be at least 16 years old to use SD Automate. By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

When you create an account with SD Automate, you are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.

• You must notify us immediately of any unauthorized use of your account or any other breach of security.
• We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for an extended period.
• One person or entity may not maintain more than one free account at any time.

You agree to use SD Automate only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your workflows and automations comply with all applicable laws and the terms of any third-party services you connect.

Prohibited Activities

You may not use the service to transmit malware, spam, or any harmful code; attempt to gain unauthorized access to other systems or networks through your workflows; violate any applicable law, regulation, or third-party rights; overload, disable, or impair the service infrastructure through excessive automated requests; or reverse-engineer, decompile, or attempt to extract the source code of the platform.

Rate Limits and Fair Use

We enforce rate limits and usage quotas to ensure fair access for all users. Your plan tier determines your workflow execution limits, API call frequency, and connected account allowances. Exceeding these limits may result in throttling or temporary suspension of service.

The SD Automate platform, including its software, design, documentation, logos, and all related intellectual property, is owned by SD Automate and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited license to use it as described herein.

You retain all rights to the workflows, configurations, and content you create using the platform. By using SD Automate, you grant us a limited license to host, process, and execute your workflow data solely for the purpose of providing the service to you.

SD Automate offers both free and paid subscription plans. By selecting a paid plan, you agree to pay the applicable fees as described on our pricing page. All payments are processed securely through Stripe.

• Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select.
• All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
• We may change our pricing with 30 days' notice. Continued use after the change constitutes acceptance.
• Failed payments may result in temporary suspension of your account until the balance is resolved.
• You may cancel your subscription at any time. Access continues through the end of the current billing period.
• Free tier usage is subject to fair use limits and may be modified or discontinued with reasonable notice.

You may terminate your account at any time by using the account deletion feature in your Settings page or by contacting us directly. Upon termination, your right to use the service ceases immediately.

Termination by Us

We may suspend or terminate your account at our discretion if you violate these Terms, engage in prohibited activities, fail to pay applicable fees, or if we are required to do so by law. Where possible, we will provide reasonable notice before termination.

Effect of Termination

Upon termination, your workflows will stop executing, your connected accounts will be disconnected, and your data will be scheduled for deletion in accordance with our data retention policy. We may retain certain information as required by law or for legitimate business purposes.

To the maximum extent permitted by applicable law, SD Automate and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the service.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

SD Automate is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SD Automate operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law.
